Some people believe that the term of the war on terror was introduced by the US President George W. Bush after the 9/11 terrorists attacks on the twin towers of USA. The term the war of terror is developed to show America’s clash with the people who have Islamic extremist thoughts. This term of the war on terror was selected by George W. Bush when the higher officials of USA wanted to introduce the term "global struggle against violent extremism† (Coaty and Babst, pp. 222–228). USA had already a strained relationship with Iraq and also with Afghanistan which was led by Taliban. This stress in relationship occurred as a result of Gulf War of 1991 but the situation worsened and the terrorists’ attacks on the Twin Towers on 9 September 2011 made the US President Bush to take some steps against terrorism. The attack on the Twin Towers is observed as the attack on humanity and not on USA alone. Terrorism is a problem which has threatened not only America but also its allies and other independent countries. Furthermore, after the 9/11 attacks on the Twin Towers the anthrax-laced letters which were sent to USA took the lives of five American people and it is thought to be the worst biological attack in the history of USA created by Islamist militant extremists, according to the Federal Bureau of Investigation (FBI). As these events occurred together so United States of America had to take an action. The union of happenings forced USA to make amendments in its foreign policy as well as domestic policy. As a consequence, American officials drafted USA Patriot Act and also developed Department of Homeland Security. These steps helped in the renovation of the security measures such as operation involving investigation and intelligence. Along with the alterations made in the domestic and foreign policy the President Bush ordered the Taliban government of Afghani stan to give Osama Bin Laden to the US government. It was suspected that Osama bin Laden was the hand behind these terrorists’ attacks and it is he who developed the whole plan of terrorism and executed it. Along with Osama bin Laden, US government wanted to capture other members of al-Qaeda which could be a threat for any further act of terrorism. ACAS means Advisory Conciliation and Arbitration Service. It was established in the year 1975 under the Employment Protection Act. The purpose of ACAS is to ensure better working life and improve the labor relations. ACAS is directed towards solving of employee problems and raising their standard of performance by conducting quality education and training programs for them. ACAS plays three important roles in improving the employee relations (Currie 1997).They are:- 1. Advisory role: ACAS can be viewed as an advisory body as it offers advisory and consultation services to the organization and employees who feel that they have been overlooked or unfairly treated. Through the informations contained in the code of conduct issued by ACAS, it shows an organization the need to maintain a fair grievances and disciplinary system. Many organizations have adopted the principles of ACAS. 2. Role of Conciliation: Here ACAS tries to resolve employee conflicts before the issue reaches the hearing phase. The conciliation officer tries to guide and make both the parties understand the probable outcome of a tribunal. 3. Role of Arbitrator:-In common practice, the employee conflicts are solved within the organization. But the need for an arbitrator arises when the internal dialogues fail to settle the issue. Most of the organizations prefer ACAS to don the role of arbitrator. While acting under this role ACAS may appoint an arbitrator or even form an arbitration board. Such decisions shall be based on the complexity and relevance of the issue. ACAS codes and principles mainly stresses on the importance of maintaining discipline in the organization(Taylor, 2005).ACAS has set specific codes and procedures to be applied on the disciplinary system and dismissal process of the company. Following are the important points covered by the ACAS code in this respect:- Every company should maintain specific and systematic disciplinary procedures and these procedures must be kept with the company in the written form. The name and designation of the person authorized for taking disciplinary actions must be separately stated. The procedure must precisely state the grounds on which disciplinary actions shall be evoked against the defaulting employee or employer. The employee has to be informed about the complaint raised against him. And he should be provided with a reasonable opportunity of being heard. The company should have fair warning system. Proper warnings have to be raised whenever it is necessary .An opportunity must be given to the employees to correct their actions. Every employee has the right to appeal. The company should have a well structured complaint redressal committee before whom the employees shall appear. The employees have the right to representation. Any employee or member of the trade union can accompany the employee during the hearing. Hence ACAS plays a very important role in ensuring a fair and effective grievance and disciplinary system in an organization. Employment Tribunal The Employment tribunals were introduced in the year 1964 for the first time under the Industrial Training Act (Pettinger 1999). Employment tribunal is another important organization which plays a very important role in promoting employee welfare in the industry. They deal with safeguarding employee rights. The tribunal is empowered to give a fair trial to the employees who have been unfairly dismissed (Chandler, Waud 2003). If an employee is dismissed on the basis of any incorrect informations or if he has been denied the right to appeal then the employment tribunal (if the employee is able to prove his innocence) shall dismiss all the allegations against him. Person, persons or bodies like labor unions filing the case to the employment tribunal is termed applicants. And the other party (employer or the company) against whom the case has been filed is termed respondents. The applicants as well as the respondents have the right to present witnesses to their support. The tribunal may require each of the parties to produce necessary documents or evidences while conducting the trial. The decisions shall be taken on just and equitable basis. Two remedies are available to the employees who have been unfairly dismissed. One is to seek re-engagement and the other is to claim compensation. The employment tribunal has the power to issue orders for re-engagement and awarding compensation for the aggrieved employee. The tribunal has been setup to provide a platform for easy settlement of disputes between the employees and the employers (Pettinger 1999).In this manner employee tribunal tries to solve the grievance of employees in a very effective manner. Oliver Wendell Holmes was born on March 8, 1941 and died on March 6, 1935. He was a vigorous political figure during his life time. He served as associate justice in the US Supreme Court from 1905 to1982. He was a great political philosopher of his days and his ideas are still remembered. According to Holmes, â€Å"the nature of legal language can obscure and hide the social interests and social advantages to some that a law promotes.† Holmes view about legal language is that law promotes social goodness for people but the manner in which the language of law is interpreted can be a block to providing equal justice to all human beings. Holmes says the interpretation of law makes it hard for others to actually enjoy the benefits law provides to all mankind. Holmes classifies the interpretation of law into rhetorical theory. He emphasizes that a law which is constructed as a principle or in a statute form reduces the likelihood of change. Again he says the language of law when interpreted tends to define or apply to only specific behavior or situation at a specific time. Legal language is constructed in complex forms that make it difficult for people without the knowledge of the laws to interpret their meaning. In addition, the language of law always depends on fi xed interpretation. In actual sense, if a law is not interpreted and therefore is not in statutes or has not being generally considered as a law then, no one can be considered a criminal for that offense. Though in reality, that offense may be morally wrong but it is yet to be discovered and entered as a legal principle thus, representing the prediction of the future consequences. Holmes further says that the interpretation of the law in a universal notion as morally obligated... ..., Holmes says legal language should be based on amendment or changes to suit current situations and not be measured from old or fixed legal principles. Indeed, Holmes’ theory that â€Å"the nature of legal language can obscure the social interests and hide the social advantage to some that a law promotes† is a very important philosophical thought. The fact is that legal language denies some people the right to social advantage or equal justice. For this reason, we should look at laws as they ought to be based on current situations at hand. We should not be predominantly obligated to follow fixed statutes as if they are holy books that have been handed down to us from our predecessors and therefore, cannot be altered or amended. Legal language should be used to serve the interest of current social treads and we should not favor legal rhetoric and traditions over change.

Plato, Machiavelli Essay

Machiavelli says the prince only has to seem good, not be good. Plato insists that seeming is bad, being is good. Nicolo Machiavelli is known as being an realist who accepted that fact that humans are brutal, selfish, and fickle while Plato was an idealist who believed people could be ruled by a philosopher king who ruled over the warriors and tradesmen of his ideal republic with rationality. In his view the philosopher-king was in charge of making the state a â€Å"utopia† in that everyone had his/her place and all worked together for the common good of the state. Machiavelli said that this was a foolish idea. Machiavelli philosophy of government was centered on the ruler. He believed the king, or despot, had the right to do whatever was necessary for his own gain, or whatever the monarch considered the â€Å"good of the state† which he called Virtu’. Machiavelli believed the only purpose for a ruler was to make war, and protect its citizens from attacks by other states. He advocated the slaughter of surrendered generals in order to crush hopes of revolution – even rationalizing that it was worth the risk of revolution should it anger the people. Machiavelli believed a ruler should be immoral using deception and illusion for power and never allowing the people to know the â€Å"real† him In Machiavelli’s time, as it is today, the States whole reason for being was to serve the citizens. The ruler, therefore, is justified in doing whatever is necessary to maintain the country or state, even if it is unjust. In Plato’s time, man served the state. According to the viewed that ethics and politics are the same, or at least co-terminous. There was no distinction between private life and public life, as there is today. Plato argues a ruler can never be unjust. Plato argues against this type of ruler, who rules solely by might. Plato tries to prove that it is always better to be just than unjust , claiming that there is a strong connection between justice , personal happiness and the well being of the state. Machiavelli underlines the fact that moral principles are not necessarily connected with the efficiency of the act of ruling . If the principles of morality and justice need to be broken in for the state to be prosperous , than this is how things should be done. In the end, Plato and Machiavelli lived very different lives, contributing to their differing thoughts on the world. Plato grew up in the upper aristocratic class but was â€Å"adopted† by Socrates. As he followed Socrates, he learned all he would need for his later life as a philosopher when he essentially wandered around Greece without pay. In this way he was untouched by wealth’s corruption. Machiavelli, on the other hand, grew up in a wealthy Italian home and lived well supplied for by his patrons. The wealth that he was accustomed to was the main cause for his philosophy centered around personal gain.

Wife of Bath

Geoffrey Chaucer expresses present day realities throughout his novel The Canterbury Tales. Throughout the Wife of Bath’s prologue, the wife illustrates her actions to be equal to those of a feminist. The wife pleads to stand out without conforming to societal standards. Feminism is defined as the doctrine advocating social, political, and all other rights of women equal to those of men. During the 14thcentury, it was likely that the Wife of Bath was thought of as a destructive rebel.In modern times our society considers the Wife of Bath to be a revolutionary feminist who refuses to conform to the expectations of women during her time. The thought of women continuously desiring attention from a man and always being sought out to express promiscuous actions is a reality revealed in the Wife of Bath’s Prologue. Lines 263 through 270 of the Wife of Bath’s Prologue reveal the wife’s view upon how men illustrate the actions of women. And if she is ugly, you say that she covets every man she sees; for she will leap on him like a spaniel until she finds some man who will buy her wares. † The quote explains that this woman is not able to persuade a man or even capable of being pursued because her looks are not appeasing, she must use her sexuality in order to have her way or get what ever she wants. Though this may be a negative view of women, this simply says women receive no recognition. Whatever a woman does, it is never good enough for a man’s desire.The Wife of Bath’s Prologue also expresses the idea of women not pleased or wanting to be controlled neither having a master but instead searching for sovereignty in relationships. The 14th Century was a very relevant time of which women were controlled by their husbands. â€Å"We don’t love a man who carefully watches where we go; we want to be at large. † (Lines 321-322) This quote simply explains that women do not want to be controlled, as men do – they also want power of themselves and to go about things as they please. Women sometimes go after a love that they do not possess for the purpose of gaining more power.
